Progressivism, Juvenile Court, Social Structure theory and New Jersey v. TLO: A Train Wreck in Americas Courts
This paper is about the 1984 New Jersey v. TLO case that appeared before the US Supreme Court. The justices broke with a twenty-year trend that had seen a movement towards giving youth offenders the same rights before the courts as adult offenders. This ruling came along at a time when youth offenders in America were also seeing the old parents patriaeh juvenile court approach replaced by one that de-emphasized rehabilitation and emphasized accountability.
